1. Services Agreement

All construction, renovation, and consultancy services provided by FBC are subject to a separate written agreement between FBC and the client. These Terms and Conditions supplement any such agreement but do not replace it. In case of any inconsistency between these Terms and Conditions and a written service agreement, the terms of the written service agreement shall prevail.

2. NHBRC Certification

FBC is a certified member of the National Home Builders Registration Council (NHBRC) with registration number 23841. All our residential construction projects comply with NHBRC standards and regulations. Our certification represents our commitment to quality and adherence to industry standards.

3. Project Estimates and Quotes

All estimates and quotes provided by FBC are:

• Valid for 30 days from the date of issuance unless otherwise specified
• Subject to change based on site conditions, material price fluctuations, or scope modifications
• Exclusive of any unforeseen circumstances that may arise during construction
• Binding only when accepted in writing and accompanied by the required deposit

4. Payment Terms

Unless otherwise specified in a written agreement, our standard payment terms are as follows:

• 50% deposit required before commencement of work
• 30% payment at project mid-point or as specified in the project timeline
• 20% final payment upon project completion and client sign-off
• All payments are due within 7 days of invoice date
• Late payments may result in work suspension and/or late payment fees of 2% per month

5. Project Timeline and Delays

FBC commits to completing projects within the agreed-upon timeline. However, certain factors beyond our control may cause delays, including:

• Adverse weather conditions affecting construction safety or quality
• Delays in obtaining necessary permits or approvals
• Client-requested changes to the original scope of work
• Material shortages or delivery delays from suppliers
• Discovery of unforeseen site conditions requiring additional work

FBC will communicate any anticipated delays promptly and work diligently to minimize their impact on the overall project timeline.

6. Quality Assurance and Warranties

FBC provides the following warranties for our construction work:

• 5-year structural warranty on all new construction
• 1-year workmanship warranty on all renovation work
• Manufacturer warranties on materials and installed equipment

These warranties are subject to proper maintenance by the client and do not cover damage due to improper use, natural disasters, or normal wear and tear.

7. Change Orders

Any changes to the original scope of work must be documented in a written change order, signed by both parties. Change orders may affect the project timeline and cost. FBC reserves the right to adjust the project schedule and price accordingly.

8. Client Responsibilities

Clients are responsible for:

• Providing accurate information regarding property boundaries and existing structures
• Securing necessary permits and approvals unless specifically included in FBC's scope of work
• Ensuring site accessibility during working hours
• Timely decision-making on selections and approvals
• Prompt payment according to the agreed schedule

9. Intellectual Property

All architectural designs, plans, and drawings created by FBC remain our intellectual property unless otherwise specified in writing. Clients receive a license to use these designs for the specific project only. Reproduction, modification, or use for other projects without FBC's written consent is prohibited.

10. Confidentiality

FBC respects client confidentiality and will not disclose sensitive project details to third parties without client consent. However, FBC reserves the right to use photographs of completed projects in our portfolio and marketing materials unless the client explicitly requests otherwise in writing.

11. Termination

Either party may terminate the service agreement with written notice in case of material breach by the other party. In the event of termination:

• The client will be responsible for payment for all work completed up to the termination date
• FBC will provide all relevant project documents and materials to the client
• Materials purchased specifically for the project will be billed to the client

12. Dispute Resolution

In case of disputes, both parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through mediation before pursuing legal action. The laws of South Africa shall govern these Terms and Conditions.

13. Liability Limitation

FBC's liability for any claim arising from our services shall not exceed the total amount paid by the client for the project. We shall not be liable for indirect, consequential, or incidental damages, including but not limited to loss of profit or business opportunity.

14. Insurance

FBC maintains comprehensive liability insurance and worker's compensation coverage as required by law. Proof of insurance can be provided upon request.

15. Force Majeure

Neither party shall be liable for failure to perform obligations if such failure is due to events beyond their reasonable control, including but not limited to natural disasters, acts of government, civil unrest, or pandemic-related restrictions.

16. Website Use

The content of our website is for general information purposes only. FBC makes no warranties about the completeness, reliability, or accuracy of this information. Any reliance you place on such information is strictly at your own risk.

17. Privacy Policy
